By downloading or using ELEVI, you agree to these terms. If you do not agree, please do not use the application.

1. The ELEVI Service

ELEVI is an ad-free, premium streaming platform dedicated to independent cinema. We grant you a personal, non-exclusive, non-transferable license to stream our content for personal, non-commercial use only.

2. Intellectual Property & Piracy

The films on ELEVI are the property of their respective creators. You may not download, screen-record, screenshot, distribute, or publicly exhibit any film found on ELEVI. Any attempt to pirate or redistribute content will result in immediate account termination and potential legal action.

3. Subscriptions and Billing

ELEVI PREMIUM SUBSCRIBER AGREEMENT This Subscriber Agreement ("Agreement") governs your acquisition and use of the premium auto-renewable subscription tiers provided by ELEVI ("Service"). By purchasing a subscription, you explicitly agree to the terms outlined below.

1. Subscription Tiers and Access ELEVI operates on a freemium architecture. Unauthenticated and free-tier registered users are granted basic platform exploration rights, custom Watchlist creation capabilities, and limited free previews (up to 30 seconds per film). Purchasing an auto-renewable subscription (Monthly Premium or Yearly Premium) unlocks full, unrestricted access to the complete cinematic short film catalog across all supported platforms.

2. Billing, Auto-Renewal, and In-App Purchases Depending on where you purchase your subscription, the transaction is processed securely through the respective platform's native payment gateway (Apple StoreKit for iOS, Google Billing for Android) or via our secure web payment partner, Stripe, for purchases made directly on the ELEVI website.

  • Billing Cycle: Your subscription will automatically renew at the end of each billing cycle (monthly or annually) unless auto-renewal is explicitly disabled.

  • Charges: Your payment method linked to your Apple ID, Google Account, or Stripe profile will be charged for renewal within 24 hours prior to the end of the current billing period.

  • Pricing Changes: ELEVI reserves the right to adjust subscription pricing. Any price changes will be communicated to you in advance, and you will have the opportunity to accept or decline the new rate before the billing cycle automatically renews.

3. Cancellation Policy You may cancel your premium subscription at any time. To avoid being charged for the next billing cycle, you must disable auto-renewal at least 24 hours before the expiration of your current subscription period.

  • Managing Subscriptions: Cancellations must be executed through the platform where you originally purchased the subscription. If purchased via Apple or Google, you must cancel directly within your device's native App Store Account Settings. For subscriptions purchased on our website, you may cancel by accessing the Stripe Billing Portal via the "Manage Subscription" button in your ELEVI account settings. ELEVI cannot manually cancel native platform (Apple/Google) subscriptions on your behalf.

  • Post-Cancellation Access: If you cancel your subscription, you will retain full premium streaming access until the end of your currently paid billing period. ELEVI does not provide pro-rated refunds for mid-cycle cancellations.

4. Multi-Device Synchronization Your premium subscription entitlement is attached to your core ELEVI account context. To enjoy cross-platform streaming access across distinct target hardware (e.g., streaming from your iOS mobile app to a desktop web interface), you must authenticate using the matching credentials linked to the originating subscription purchase.

5. Geographic Availability and Content Delivery Cinematic assets available within the application may vary based on geographic licensing agreements. ELEVI utilizes dynamic Content Delivery Networks (CDNs) to stream encrypted video media. You are responsible for securing adequate internet bandwidth to ensure uninterrupted high-definition playback. ELEVI is not liable for stream degradation resulting from local network ISP throttling or client-side hardware limitations.

6. Termination of Access ELEVI reserves the right to immediately suspend or terminate your subscriber access without refund if we determine, in our sole discretion, that you have violated these Terms, engaged in fraudulent receipt validation attempts, attempted to bypass digital rights management (DRM) encryptions, or utilized automated scraping protocols to download proprietary media files.

4. Acceptable Use & Anti-Fraud

ELEVI distributes revenue to creators based on watch time. Any attempt to artificially inflate watch time using bots, automated scripts, or repeated background viewing is strictly prohibited. We employ automated anti-fraud caps, and accounts found engaging in fraudulent behavior will be permanently banned.

5. Account Termination

We reserve the right to suspend or terminate your account at any time, without notice, if we determine that you have violated these Terms of Service.

7. END USER LICENSE AGREEMENT (EULA) FOR MOBILE APPLICATIONS

If you download and access the ELEVI mobile application ("App") through the Apple App Store or Google Play Store, your use of the App is subject to the following additional terms:

1. Scope of License ELEVI grants you a non-transferable, non-exclusive, revocable license to use the App on any Apple-branded or Android-branded products that you own or control, strictly as permitted by the Usage Rules set forth in the respective App Store Terms of Service. This App is licensed, not sold, to you.

2. Maintenance and Support ELEVI is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You acknowledge that Apple Inc. ("Apple") and Google LLC ("Google") have no obligation whatsoever to furnish any maintenance and support services with respect to the App.

3. In-App Purchases and Subscriptions The App offers auto-renewable subscriptions to unlock premium content. Payment will be charged to your App Store or Google Play Account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24-hours before the end of the current period. Your account will be charged for renewal within 24-hours prior to the end of the current period. You may manage your subscriptions and turn off auto-renewal by going to your device's Account Settings after purchase.

4. Warranty and Liability The App is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, ELEVI disclaims all warranties, express or implied. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if applicable). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

5. Product Claims You acknowledge that ELEVI, not Apple or Google, is responsible for addressing any claims of the end-user or any third party relating to the App or your possession and/or use of that App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

6. Intellectual Property Rights In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, ELEVI, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

7. Legal Compliance You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

8. Third-Party Beneficiary You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this license, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
